Judge Aileen Cannon has rejected an effort by Donald Trump to toss his classified documents case based on the Presidential Records Act.
Trump argued that the more than 300 classified records the FBI recovered at his Mar-a-Lago resort in Florida could have been considered his personal records under the PRA.
Cannon rejected that argument noting that prosecutors “make no reference to the Presidential Records Act” in the indictment against Trump and did not “rely” on the statute to bring charges, CNN reports.
“The Presidential Records Act does not provide a pre-trial basis to dismiss,” Cannon wrote.
However, Cannon did not rule out the possibility of Trump raising the issue again at trial or in other pretrial proceedings.
