Capitol rioter brags about his high IQ then asked judge for permission to fight prison guards.

A Capitol riot defendant who is accused of assaulting several officers on Jan. 6 bragged about how smart he is in court then immediately asked the judge for permission to fight prison guards.

At a status hearing for his case on Thursday, Josiah Kenyon, 34 indicated to Judge Carl Nichols that he wanted to say something. Nichols told Kenyon to talk with his attorney before saying anything but he ignored the advice, telling the judge, “I have a high enough IQ range to not screw up there, boss.”


Kenyon then asked the judge to acknowledge that he has the right to defend himself if he is getting assaulted by corrections officers, according to Politico’s Kyle Cheney.

Nichols said he would not be “making any finding one way or another” about his right to defend himself while incarcerated, to which Kenyon responded “okey doke.”

At the end of the hearing, Nichols asked Kenyon if he had any other issues to raise.

“My wife and children [are] homeless on the street. Have a wonderful day,” Kenyon replied.


According to court documents, Kenyon stormed the Capitol on Jan. 6 wearing a MAGA hat and dressed as Jack Skellington, a character from the movie The Nightmare Before Christmas.

He allegedly assaulted officers with multiple items including “a table leg with a protruding nail,” the FBI said.

He was arrested in Reno, Nevada on Dec. 1, 2021 and charged with unlawfully entering the Capitol and assaulting a police officer.
