DC man faces felony charge after allegedly spitting on National Guard troops.

The Trump Justice Department is charging a man with felony assault after he allegedly spat on National Guard members stationed inĀ  Washington DC.

According to court documents, Scott Pichon was riding his electric scooter past National Guard troops at Union Station on Aug. 22 when Sergeant Robert Underwood claims he heard the “man make a noise like he was coughing up mucus” and saw him spat it on two members of the South Carolina National Guard.

Documents say the “mixture of saliva and mucus” landed on the officers’ “chest and face area.”

Earlier this month, Donald Trump ordered the national guard to Washington DC and seized control of the city’s police force, describing the city as crime-ridden despite data showing crime at a 30-year low.

Former Justice Department official Sean Dunn, 37, was slapped with a similar charge after throwing a sandwich at a Customs and Border Protection officer, then ran into the street as officers chased him.

Dunn’s lawyer argued that the felony assault charge was too excessive. He has been released from custody on his own recognizance.

Former Fox News host turn U.S. Attorney Jeanine Pirro’s office revealed in court that they sought the indictment of a D.C. woman on the same charge as Dunn and Pichon and wasĀ rejected all three times.

That woman, Sydney Reid, was accused of assaulting an FBI agent during an inmate transfer with Immigration and Customs Enforcement (ICE) in July.Ā 

Pirro’s office said on Monday that it would move ahead with chargingĀ  Reid with a misdemeanor version of the charge.
