Conservative ex-federal judge says it is the Constitution that’s disqualifying Trump from office, not Democrats.

During an appearance on MSNBC Saturday, former federal judge and prominent conservative Michael Luttig said Democrats aren’t the ones disqualifying Donald Trump from office, it’s the United States Constitution.

Earlier this week the Colorado Supreme Court barred Trump from their state ballot in 2024 under the 14th Amendment insurrection clause.

Several Republicans slammed the ruling as political and some state lawmakers have even floated removing Joe Biden from their state ballots in retaliation.

On Saturday, Luttig said that Republicans’ anger is misplaced since Biden and Democrats have nothing to do with disqualifying Trump from the ballot.

“It is a natural and expected reaction by all Americans. But upon thinking about it seriously, I think it’s crystal clear,” Luttig said.

“It will be crystal clear to the American public that it’s the Constitution of the United States that’s disqualifying the former president from higher office, if he is to be disqualified,” he continued. “To speak to the political warriors, it’s not President Joe Biden. It’s not the Democrats. It’s not the anti-Trumpers.”

In the Colorado Supreme Court ruling, the judges argued that Trump was involved in an insurrection by promoting false claims of election fraud and encouraging his supporters to storm the US Capitol on Jan. 6, 2021 to prevent the certification of Biden’s victory.

The Colorado Supreme Court stayed its decision until Jan. 4, or until the U.S. Supreme Court rules on the case.

At the center of the case is whether or not the 14th Amendment applies to the presidency.

Luttig said Saturday that it is “impossible” for SCOTUS to interpret the 14th Amendment any differently than Colorado’s high court, according to The Hill.
