A judge on Monday indicated that former Alaska Gov. Sarah Palin (R) defamation lawsuit against the New York Times will be thrown out.
U.S. District Court Judge Jed Rakoff says he would dismiss the case because Palin’s attorneys failed to produce evidence to suggest the news organization acted recklessly or knowingly published false material about her, according to Politico.
The ruling came as a Manhattan jury is still in deliberations. Judge Rakoff said he would allow the jury to continue deliberations and would consider an appeal in the case to be inevitable.
Palin is suing the paper claiming that a 2017 editorial damaged her reputation by falsely asserting that her political rhetoric helped incite the 2011 shooting of then-Arizona U.S. Rep. Gabby Giffords in Tucson, Arizona.
