A federal judge has agreed to dismiss Sidney Powell’s lawsuit against Dominion Voting System.
Dominion filed a defamation lawsuit against Powell last year, seeking $1.3 billion in damages after she accused the company of manipulating the results of the 2020 presidential election, tipping it in President Joe Biden’s favor.
Powell countersued the company months later seeking $10 million. She called Dominion’s $1.3 billion defamation suit against her a ‘ludicrous’ abuse of the legal system intended to intimidate her for speaking out.
On Wednesday, U.S. District Judge Carl Nichols tossed the lawsuit after finding that Powell failed to prove how Dominion’s defamation lawsuit against her is an abuse of justice.
“Powell must allege that Dominion, after filing its suit, performed some act that perverted the judicial process,” Nichols wrote. “But Powell’s complaint fails to link her abuse-of-process claim to any act that Dominion has taken other than filing and pursuing its lawsuit. She has thus failed to state a claim for abuse of process.”
