The Republican leader of the Kansas state was arrested earlier on Tuesday on suspicion of driving under the influence.

Majority Leader Gene Suellentrop, was booked into the Shawnee County jail just before 4 a.m, according to jail records. He is charged with driving under influence of drugs or alcohol, fleeing or attempting to flee from a law enforcement officer, speeding and improperly crossing a divided highway.

Later Tuesday, Shawnee County District Judge Penny Moylan ordered his release after finding that there was not enough evidence to support his arrest hours earlier on suspicion of driving under the influence and attempting to flee from a law enforcement officer, The Associated Press reports.
