Lawsuit filed to remove Pennsylvania MAGA congressman from the ballot.

Activists in Pennsylvania are pushing to disqualify Rep. Scott Perry (R) from the ballot.

Gene Stilp, an activist and former Pennsylvania congressional candidate, filed the lawsuit Tuesday asking Pennsylvania’s Secretary of State Albert Schmidt to decide whether Perry is eligible to run for office under the U.S. Constitution’s 14th Amendment.

Stilp cited Perry’s involvement in an effort to stall the certification of election results by installing former Justice Department official Jeffrey Clark as the acting attorney general during the final months of the Trump administration. 

Clark was pushing for the DOJ to investigate the election on baseless claims of widespread voter fraud.

Perry, who currently serves as the chairman of the House Freedom Caucus, has not been charged with a crime relating to the Jan. 6 Capitol riot.

“Congressman Perry is focused on critical problems facing south central Pennsylvania and our Nation, which is why he’s traveling with the Speaker of the House today to examine the ongoing crisis at our southern border,” Matt Beynon, a campaign spokesperson for Perry said in a statement.

Similar efforts to remove other lawmakers over their alleged role in the Capitol insurrection has failed. But, there is a renewed interest in the effort after former President Donald Trump was disqualified from the ballot in Colorado and Maine under the 14th Amendment.

The Trump campaign has challenged the decisions and the case will likely end up being decided by the Supreme Court.
