Robert F. Kennedy Jr. is accused of committing felony election fraud when he voted in the 2024 election.
In a complaint filed with the New York State Board of Elections on Wednesday watchdog group Accountable.US alleged that RFK Jr committed voter fraud by “registering for and voting” from “a New York residence at which he does not legally reside,” Politico reports.
The complaint states that RFK Jr sent his mail-in ballot from Katonah about 45 miles from New York City. The ballot was received by the Westchester County board of elections on Nov. 2.
However, last August a New York judge ruled in favor of a legal challenge launched by another watchdog group, Clear Choice Action, who argued that RFK Jr does not live at the Katonah address.
RFK Jr had claim he was renting a room from a childhood friend in Katonah, but that friend’s spouse testified that he had only stayed at the property for one night, Politico noted.
RFK Jr’s name was subsequently removed from the ballot in New York because he included an invalid address on his nominating petition.
“New York statute … provides that any person who ‘[k]nowingly gives a false residence within the election district when registering as an elector’ is guilty of a felony,” Accountable.US wrote in the complaint.
The complaint called on the New York State Board of Elections to “investigate Robert F. Kennedy Jr. for apparent violations of New York’s Election Law by registering for and voting in the November 5th, 2024 general election from a New York residence at which he does not legally reside.”
The accusation comes as RFK Jr, a prominent anti-vaxxer, is set to face Senate confirmation process after he was nominated by Donald Trump to lead the Department of Health and Human Services.
“Not actually living in New York in the eyes of the law allegedly did not stop RFK Jr. from casting his election ballot there illegally,” Tony Carrk, the executive director of Accountable.US, said in a statement.
“Senators should press Kennedy on whether he intends to play by his own rules and thumb his nose at the law as HHS Secretary, like President-elect Trump is wont to do,” he added.
