Senate Republicans voted Tuesday to confirm an election denier who served as Donald Trump’s personal attorney for a lifetime seat on the federal bench.

Justin Smith,41, was confirmed on a 48-43 vote for a lifetime seat on the U.S. Court of Appeals for the Eighth Circuit. Every Democrat present voted no, and every Republican present voted yes, except for Sen. Lisa Murkowski (R-Alaska).

Sens. Michael Bennet (D-Colo.), Kevin Cramer (R-N.D.), John Curtis (R-Utah), Angus King (I-Maine), Ben Ray Luján (D-N.M.), Cynthia Lummis (R-Wyo.), Mitch McConnell (R-Ky.), Bernie Sanders (I-Vt.), and Raphael Warnock (D-Ga.) all missed the vote, according to Huffpost.

Smith is a former Trump attorney who represented the president in his immunity case at the Supreme Court. He was also the lead Supreme Court lawyer in Trump’s fight to overturn rulings in defamation cases brought by journalist E. Jean Carroll.  Smith continued to represent Trump as a member of his legal team in Carroll’s case even after he was nominated to the federal bench in March.

At his confirmation hearing in April, Smith refused to say whether he would recuse himself from any Trump-related cases that come before the court. He also refused to admit that there was an attack on the Capitol on Jan.6 2021 and that Joe Biden won the 2020 presidential election.

Since the start of Trump’s second term in office, he has handed out posts in the Justice Department or judicial nominations to at least 10 of his former personal attorneys, according to an analysis by Politico. They include Todd Blanche, who is currently serving as acting attorney general and Emil Bove, who is currently a judge on the 3rd Circuit Court of Appeals.
