Texas Lt. Gov. Dan Patrick threatened to take President Joe Biden off the 2024 ballot in the state in response to the Colorado Supreme Court ruling that Donald Trump should not be allowed on their state ballot.
In a 4-3 vote on Tuesday, Colorado’s highest court kicked Trump off the ballot under the 14th Amendment insurrection clause which bars from office anyone who swore an oath to “support” the Constitution and then “engaged in insurrection or rebellion” against it.
The court argued that Trump was involved in an insurrection by promoting false claims of election fraud and encouraging his supporters to storm the US Capitol on Jan. 6, 2021.
Patrick called the move by Colorado’s high court undemocratic, but said that Republicans in Texas may do the same to Biden.
“Maybe we should take Joe Biden off the ballot in Texas for allowing 8m people to cross the border since he’s been president, disrupting our state far more than anything anyone else has done in recent history,” he told Fox News Laura Ingraham.
Patrick and Texas Republicans cannot remove Biden from the ballot without a lawsuit making its way through the courts as was the case in Colorado. Furthermore, Biden did not lead an insurrection which would warrant such a move under the 14th Amendment.
