Former Trump White House attorney Ty Cobb blasted Judge Aileen Cannon on Tuesday for indefinitely postponing the ex-president’s classified documents case.
“All she’s really done today, though, is make official what everybody, including Jack Smith, already knew, which was she had no intention of getting this case to trial,” Cobb told CNN’s Erin Burnett on Tuesday.
Trump has been charged with willfully retaining classified documents after leaving the White House and for obstructing the federal government’s efforts to retrieve them.
On Tuesday Cannon, a Trump appointee, postponed the start of the trial arguing that setting a trial date at this point would be “imprudent” because several pretrial motions are unresolved.
“She talks about her duty to fully and fairly consider the pending motions. She’s had months to do that and did very little,” Cobb said in a clip shared by Mediaite. “She’s ruled on only three of the 12 motions to dismiss, all of which could have been easily resolved now.”
Cobb argued that Cannon”s decision to postpone the trial was a “combination of bias and incompetence.”
“I do think she is not capable of ruling intelligently or fairly on most of the motions that will be pending, and certainly the classified information issues,” Cobb added. “And I think at some point she will be removed in advance of trial. But keep in mind, this case now can’t go to trial until mid to late 2025. And it won’t go to trial if Trump is elected.”
Cobb has been critical of Cannon’s handling of the case and said last month that he expects her to be removed from the case.
“I think the 11th circuit will likely take her off the case,” Cobb saod ar the time adding, “she may be incompetent, but at this stage of the game, her incompetence is so gross that I think it clearly creates the perception of partiality and her attempt to put her thumb on the scale. So, I think that should disqualify her.”
