Former Trump White House lawyer Ty Cobb predicted that Judge Aileen Cannon will be removed from the former president’s documents case saying the “evidence of her bias is pretty palpable”.
“I recognize that many commentators today have tried to be polite about Judge Cannon’s missteps here and suggesting that they relate somehow to her experience or incompetence. I think the evidence of her bias is pretty palpable at this stage of the game,” Cobb told CNN’s Erin Burnett when asked what he thinks of Cannon’s “stalling.”
Trump was indicted last year by Special Counsel Jack Smith for alleged mishandling of classified documents and obstruction of justice after he left the White House.
Cannon, a Trump appointee, has made a series of rulings that always aligned with Trump’s effort to delay the start of the trial, including appointing a special master to review the materials and recently jury instructions based on interpretations of the Presidential Records Act, which earned a strong rebuke from Smith. Cannon was also rebuked by the 11th circuit, twice, for her handling of the case.
Notably, Cannon still hasn’t set a date for the start of the trial.
“Her delays here are extraordinary. I mean, as you highlighted as others highlighted, she hasn’t even set a trial date,” Cobb said, according to a clip highlighted by Mediaite. “That’s remarkable. She ignored the government’s request months ago to set the schedule under the Classified Information Procedures Act that there are multiple steps that have to be gone through and she hasn’t she hasn’t completed step one. I think that alone, frankly, doomed the case to not start before the election or next year’s inauguration of whomever wins.”
“I think the 11th circuit will likely take her off the case,” Cobb predicted, adding, “she may be incompetent, but at this stage of the game, her incompetence is so gross that I think it clearly creates the perception of partiality and her attempt to put her thumb on the scale. So, I think that should disqualify her.”
