Grand juror told DOJ lawyers their case against protesters was “a crock of sh*t”

A grand juror was dismissed after telling Justice Department lawyers that their case against protesters in Chicago, Illinois was “a crock of sh*t.”

Last year, a special federal grand jury indicted six people for allegedly blocking vehicles outside of a federal immigration facility in Broadview, Illinois. Among those indicted was then-Democratic congressional candidate Kat Abughazaleh.

The charges were dismissed last month at a hearing that revealed apparent misconduct by Justice Department lawyers before a grand jury.

U.S. District Court Judge April Perry told DOJ lawyers that she was “incredibly shocked” by what she saw in the grand jury transcripts and the lawyers’ attempt to cover up their behavior through redactions.

“I have never seen the types of prosecutorial behavior before a grand jury that I saw in those transcripts,” Perry said, according to the Chicago Sun Times. “Mistakes happen. They happen to all of us. But as I tell my children, you own it. You admit to it. You apologize for it, and you move on. What you do not do is hide it.”

Perry said she believes the legal principle that assumes federal officers are acting in good faith. But “that trust has been broken.”

One notable issue was that the case was already rejected by grand jurors and DOJ attorneys failed to inform the grand jury of the prior ‘no true bill’ that was returned when the previous grand jury rejected the charges.

That fact led to a truly remarkable exchange between prosecutor Sheri Mecklenburg and a grand juror, highlighted by Capitol News Illinois legal affairs reporter Hannah Meisel in the grand jury transcripts released Tuesday.

“Are you actually presenting any new actual facts or just a different viewpoint on your side?” the grand juror asked.

“Okay. I’m feeling the skepticism already. Are you going to be able to listen with an open mind?” Mecklenburg asked.

“I — no,” the grand juror responded.

“Okay. Then you have to go —” Mecklenburg said.

“I heard this case like last week, and I thought it was a crock of shit then, and I still think it is,” the grand juror fired back.

Mecklenburg added that she “had the impression from last week” that the grand juror was not supportive of the case and dismissed the juror.

Other problematic events in the grand jury highlighted by Perry include the prosecutor improperly putting “her personal credibility and trustworthiness on the line in support of the charges,” having “substantive” communications with grand jurors outside of the grand jury room, and excusing grand jurors “who disagreed with the government’s case from the deliberations process,” the Times reports.
