An Oklahoma man was arrested and charged for his role in the Jan. 6 Capitol riot after his college fraternity brother saw his Facebook videos of the riot and tipped off the FBI.
Levi Roy Gable, 36, was arrested Thursday in Tulsa and charged with four misdemeanor counts of illegally going inside the Capitol on Jan. 6, 2021, and engaging in disruptive conduct, according to the Oklahoman.
Gable admitted last year that he went to the ‘Stop the Steal’ rally that preceded the attack and marched to the Capitol but said he did not go inside. However, the FBI found Capitol surveillance footage and cell tower records that place Gable inside the Capitol building during the riot.
On Jan. 10, 2021, Gable’s fraternity brother reported him to the FBI and provided agents with videos and posts from Gable’s social media accounts showing him inside the building.
“The videos … show scenes of individuals yelling or chanting while inside the U.S. Capitol building. It appears that Gable is behind the camera, filming,” according to the FBI.
In a Facebook post Gable wrote that he was “among the first people to make our way into the US Capitol Building,” the affidavit says.
“Capitol Police backed away from their stations and allowed protestors to make our way to the building,” Gable wrote in another post. “We pushed through the halls end to end, with no violence, no punches thrown or bullets fired, room to room, moving throughout the halls, letting our voices be heard. Once inside the halls, there were hundreds of police officers scattered throughout. They were vehemently restricting access to some areas. While it did get a little tense at times and there was certainly a few doors forced open, it was peaceful.”
Gable has since deleted his page. He told investigators that he decided to take down his Facebook page after hearing that those who attended the Trump rally were being harassed.
Gable was released from custody after agreeing to pay $10,000 if he misses any court appearance in the future.
