Rep. Nancy Mace (R-SC), a rape survivor, suggested that the Cornell 7 Jane Doe was not a victim of rape.

In a post on Twitter on Friday, Mace claimed Jane Doe was a willing participant in a “consensual gangbang.”

“IDK who needs to hear this, but a consensual gangbang is not a rape,” Mace wrote.

Court documents say Jane Doe was “visibly intoxicated as she had consumed about 10 standard drinks within the past 3 hours” before arriving at the Chi Phi frat house. Jane Doe said she was led into the house by three or four fraternity members standing by the front door.

She alleges one of them then gave her more beer and danced with her before pulling her into a quiet area to ask whether she’d like to engage in a threesome with him and another member of the fraternity.

“In her drunken state, [she] was incapable of consenting to this proposition,” her lawsuit states. Still, she wound up in a room with two men, where she was pressured into snorting ketamine and started having sex with her.

Soon after, another man came into the room and began to engage in sex with her as well. Jane Doe said she hid under the covers, but more men arrived — kissing her, groping her, and trying to initiate sex as she pushed them away.

Some on the right have accused Jane Doe of lying about the encounter. Megyn Kelly, a sexual assault survivor herself, went as far as to attack Jane Doe’s looks and suggested that she enjoyed being raped by the frat boys.

“I’m just gonna be honest, she’s not the most attractive gal. She’s extremely beefy in like her arms and her legs. She has a whole video online talking about her cankles. And she possibly enjoyed being admired,” Kelly said. “She’s probably thrilled to be so admired because she clearly didn’t grow up the incredibly beautiful one.”

She continued: ‘That the girl who was never the most sought after suddenly had four guys who wanted to have sex with her. And she counted this, yeah, in her inebriated state, as a win. And liked the feeling of being sexy and desired and wanted. It happens. Sorry, it does. And that’s why she kept saying yes. Why do we have to go right to she’s a victim? Even she took weeks to get there.”

Thomas P. Giuffra, Jane Doe’s attorney, fired back in an interview with The Daily Beast, “Perhaps she should reflect why it is difficult for women to come forward under these circumstances and honor the courage that it takes.”

Guiffra also noted Kelly’s own allegations of sexual harassment against Roger Ailes, which she took over a decade to report.

“Ms. Kelly has publicly condemned Ms. Doe for taking two weeks to go to the police. I would ask Ms. Kelly why it took her over a decade to report unwanted sexual advances from her boss,” Giuffra said.
